Expert witness services
Capability
Our expert witness capability extends to over 100 experts, operating
in 80 specialist areas with membership of
34 professional bodies. All ADAS experts
are experienced consultants practising their particular specialisms within
the industry. Consultants do not spend more than 50% of their time on
expert witness work which means that they retain their practical experience
and knowledge of the industry in which they operate.
Instructions
We are instructed by Lawyers, Insurance Companies and Loss Adjusters
on a wide range of topics and in a variety of proceedings. We undertake
a balance of claimant and defendant work (50:50) and accept instructions
as Single Joint Experts (SJE). We are also able to offer our expert witness
capability in a number of advisory roles.
Initial Free Consultation
We undertake to provide a confidential, free and without obligation consultation
on cases prior to the offer/acceptance of instructions.
Fees
All work undertaken is calculated on an agreed hourly rate. Each case is
assessed and a quotation provided prior to the acceptance of instructions.

Single Joint Expert (CPR 35.7-8)
A "Single Joint Expert" may be instructed where two or more
parties wish to submit expert evidence to be given by one expert only.
For example, where the court gives direction under rule 35.7 for a single
joint expert to be used.
Lead Expert (CPR Rule 35.7)
Where more than one expert is instructed and a single expert is required
to take the lead in co- ordinating the role of the other experts.
Sole Expert
A "Sole Expert" may be instructed by either party, claimant
or defendant. In either case the overriding duty of the expert is to the
court.

Expert Advisor
An "Expert Advisor" may be instructed in an 'advisory role'.
This is to help the party/lawyer decide if there is a case and against
whom. Instructing an expert advisor may be of assistance in conditional
fee cases and when a fast report is required for a modest fee.
Shadow Expert
A "Shadow Expert" may be instructed when a party wishes to
receive expert assistance during the course of litigation. For example,
where assistance is required with looking at and preparing written or
cross-examination questions on a single joint or opposing expert's report.
Internal clearing house
To avoid actual and potential conflicts of interest where ADAS may be
instructed by more than one party in a dispute we operate an internal
clearing house. A Standard clearing house requires a period of 21 days
or an Urgent clearing house may be undertaken in 7 days if required.

Training
It is our policy to ensure that all consultants that undertake expert
evidence in the civil and criminal courts are appropriately trained in
the legal aspects of report writing, giving evidence in court and the
Civil Procedure Rules.
